Terms & Conditions
Welcome to Best in Town. These Terms and Conditions ("Terms") govern your access to and use of the Best in Town mobile application, website, and related services (collectively, the "Service"). Please read these Terms carefully before using the Service.
By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
1. About Us
The Service is operated by Best in Town GbR, a partnership (Gesellschaft bürgerlichen Rechts) registered in Germany, with its registered address at Luxemburger Str. 152, 50937 Köln.

In these Terms, "we", "us", and "our" refer to Best in Town. "You" and "your" refer to you, the user of the Service.
2. Eligibility
To use the Service, you must:
- Be at least 16 years old, or the minimum age of digital consent in your country if higher
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable law
If you are under 18, you confirm that you have permission from a parent or legal guardian to use the Service.
3. Your Account
3.1 Account creation
To access most features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information up to date.
3.2 Account security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at support@best-in-town.org if you suspect unauthorized use of your account.
3.3 One account per person
You may not create multiple accounts, share your account with others, or impersonate another person.
4. The Service
4.1 What we provide
Best in Town is a platform that lets amateur athletes register for sport-specific leagues in their city, challenge other players, schedule matches at physical venues, submit match results, and accumulate individual ranking points based on match outcomes.
4.2 What we do not provide
We do not organize, supervise, referee, or insure any matches. All matches take place between users at locations they choose. We are not a sports club, league operator, or insurance provider.
4.3 Service changes
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any such changes.
5. User Conduct
When using the Service, you agree NOT to:
- Submit false match results or manipulate the ranking system
- Collude with other users to artificially inflate or deflate ratings
- Harass, threaten, discriminate against, or abuse other users
- Post or share content that is illegal, defamatory, obscene, hateful, or infringes the rights of others
- Use the Service for any commercial purpose without our written permission
- Attempt to gain unauthorized access to the Service, other accounts, or our systems
- Use bots, scrapers, or other automated means to access the Service
- Reverse engineer, decompile, or attempt to extract the source code of the Service
We reserve the right to investigate suspected violations and to suspend or terminate accounts that breach these rules.
6. Matches, Results, and Rankings
6.1 Match results
Match results submitted through the Service must be confirmed by all participating players. Unconfirmed results may be auto-confirmed after a displayed period as submitted.
6.2 Ranking system
Ranking points are calculated by our automated rating system. The algorithm, formulas, and parameters may change at any time without prior notice. Rankings are provided for entertainment purposes only and have no monetary value. Ranking is valid for one season and will be resetted for a new season.
6.3 Disputes between users
If you disagree with a submitted result or another user's conduct, you may report it through the Service. We may, at our sole discretion, adjust results, suspend accounts, or take other appropriate action. We are not obligated to act as a mediator and our decisions in such matters are final.
7. User-Submitted Content
7.1 Venues, photos, and other content
Users may suggest venues, upload profile photos, and submit other content ("User Content"). You retain ownership of your User Content but grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content within the Service for the purpose of operating and promoting it.
7.2 Your responsibilities
You represent and warrant that you have all necessary rights to the User Content you submit and that it does not violate any third-party rights or applicable laws.
7.3 Removal
We may remove any User Content at our discretion, particularly if it violates these Terms or applicable law.
8. Health, Safety, and Assumption of Risk
Participation in sports involves inherent physical risks, including injury. By using the Service to arrange or participate in matches, you acknowledge and agree that:
- You participate in all physical activities at your own risk
- You are solely responsible for assessing your own physical fitness, the suitability of the venue, weather conditions, equipment, and other risk factors
- We do not provide medical advice, supervision, refereeing, or insurance
- We are not responsible for injuries, damage, or losses arising from your participation in matches arranged through the Service
We strongly recommend that you maintain appropriate personal health and accident insurance.
9. Venues and Third Parties
Venues listed in the Service are physical locations operated by third parties or accessible to the public. We do not own, operate, or control these venues.
- You are responsible for complying with the rules, opening hours, and fees of any venue
- Availability of a venue in the Service does not guarantee you the right to use it; you may need to book or pay separately
- We are not liable for the condition, availability, or safety of any venue
10. Intellectual Property
The Service, including all software, design, text, graphics, logos, and trademarks (other than User Content), is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. All other rights are reserved.
11. Premium Features and Payments
We may offer paid features, subscriptions, or in-app purchases ("Premium Features"). If you purchase Premium Features:
- Prices, billing cycles, and terms will be displayed at the point of purchase
- Payments are processed by third-party payment providers (e.g., Apple App Store, Google Play). Their terms apply to the transaction
- Subscriptions automatically renew unless you cancel before the end of the current billing period through your app store account settings
- Statutory rights of withdrawal under EU consumer law apply where required
We are not obligated to issue refunds except as required by law.
12. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal data. By using the Service, you also agree to our Privacy Policy.
13. Termination
13.1 By you
You may delete your account at any time through the Service or by contacting support@best-in-town.org.
13.2 By us
We may suspend or terminate your access to the Service immediately, without prior notice, if:
- You breach these Terms
- Your account has been inactive for an extended period
- We are required to do so by law
- We discontinue the Service
13.3 Effect of termination
Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and governing law) will remain in effect.
14. Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, either express or implied. To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
15. Limitation of Liability
To the maximum extent permitted by applicable law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill
- Our total liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you have paid us in the twelve months before the event giving rise to the claim, or EUR 100, whichever is greater
Nothing in these Terms limits liability for gross negligence, intentional misconduct, personal injury caused by us, fraud, or any other liability that cannot be excluded under applicable law (including liability under the German Product Liability Act).
16. Indemnification
You agree to indemnify and hold us, our partners, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party rights.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email at least 14 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict of laws principles and the UN Convention on Contracts for the International Sale of Goods.
If you are a consumer resident in the EU, you also benefit from any mandatory provisions of the law of the country in which you reside.
The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Cologne, Germany, to the extent permitted by law. EU consumers may also bring proceedings in the courts of their country of residence.
19. Online Dispute Resolution
The European Commission provides an online dispute resolution platform, available at https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
20. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
21. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
